Terms & Conditions – Abermedia LTD
1. Definitions
These Terms & Conditions apply to all photography and video services provided by Abermedia,
operated by Michal Wachucik (the Photographer). The client (the Client) is the person or
organisation booking the services.
2. Booking & Contract
Any agreement confirmed via email correspondence between the Photographer and the Client shall
be considered a legally binding contract under these Terms & Conditions.
3. Booking & Payment
A booking is confirmed once agreed in writing (email or contract). Payment terms will be agreed
prior to the assignment. All prices are exclusive of VAT unless stated otherwise.
4. Availability and Substitution
In the unlikely event that Michal Wachucik is unable to attend the assignment due to illness,
emergency, another confirmed booking, or circumstances beyond control, Abermedia reserves the
right to source a suitable replacement photographer. Any replacement will be appropriately qualified
to fulfil the assignment to a professional standard.
5. Cancellations
Cancellations made within 24 hours of the scheduled shoot will be charged at 100% of the agreed
fee. Cancellations made earlier may be subject to partial charges at the photographer’s discretion.
6. Copyright
In accordance with UK Copyright law, all images and video content remain the exclusive property of
the Photographer. The Photographer retains full copyright ownership at all times.
7. Usage Rights
Upon full payment, the Client is granted an unlimited, non-exclusive licence to use the delivered
images for their intended purposes, including marketing, promotional, editorial, and internal use.
The Client may not resell or transfer usage rights to third parties without written permission.
8. Delivery
Final images will be delivered within an agreed timeframe following the shoot. Delivery format and
method will be confirmed prior to the assignment.
9. Liability
The Photographer will take all reasonable care in performing services. However, liability is limited to
the value of the contract in the unlikely event of equipment failure, data loss, or unforeseen
circumstances beyond reasonable control.
10. Health & Safety
The Client is responsible for ensuring a safe working environment. The Photographer reserves the
right to withdraw from any situation deemed unsafe.
11. Governing Law
These Terms & Conditions are governed by the laws of the United Kingdom.
12. Acceptance
By booking services with Abermedia, the Client agrees to these Terms & Conditions in full.
